Due to the penalties imposed upon us by the purveyors of services including but not limited to hotels/lodges/camps, airlines and/or other transportation providers, national parks and/or conservation areas, the following charges will apply in case of any cancellations of confirmed bookings:
An administrative fee of 30% of the total cost will be applied to all confirmed bookings. For cancellations made beyond 60 days prior to the departure date, a full refund minus the administrative fee will be issued. For cancellations made within 60 days prior to the departure date, only a credit note will be issued. The amount of credit available would be net of all the cancellation fees and penalties, subject to the terms and conditions set out by the various accommodation/transport/service providers used in the itinerary.
We will exercise our best efforts to book hotels/camps/lodges as per the itinerary. However, during the busy seasons, especially with bookings made within 60 days of the tour date, we may not be able to accommodate your first choices. In this case, we would offer you alternative accommodation options which are within the same price range of the suggested accommodations if possible, with no additional cost to you. Given that there is no availability for such options, we would have to offer you an upgrade or a downgrade and relay the price difference to you.
While we offer AMREF Flying Doctor Air Ambulance cover for the duration of your trip for up to 30 days, we strongly recommend that you take out travel/medical insurance to cover for hospital and other medical expenses. Kindly ask us about the conditions of the AMREF Flying Doctor Air Ambulance cover for tourists.
In addition, we strongly recommend the purchase of trip cancellation insurance, which is available for coverage of expenses in conjunction with cancellation due to illness or accident. Baggage insurance is also recommended. In the event that you must cancel your participation in a travel program, trip cancellation insurance may be the only source of reimbursement.
We understand that due to unforeseen circumstances, you may need to postpone your trip to a later date. If, for any reason, you need to make changes to your travel dates upon confirmation of your itinerary, you will need to request this in writing. Given that your reasons for change are deemed legitimate, such as illness or death of a family member, Amani Afrika Ltd will not charge you any administration fees to make changes. However, changes to travel dates might involve cancellations of accommodation and/or flight bookings; hence the amount of credit available for future rebooking would be net of any cancellation fees and penalties, subject to the terms and conditions set out by the various accommodation/transport/service providers used in the itinerary. While Amani Afrika will exercise its best effort to recover as much credit as possible towards your future rebooking, we cannot be held responsible for any cancellation fees and penalties imposed upon us by our service providers. We strongly suggest that you purchase travel insurance to protect yourself against trip cancellations.
Since we do not impose any administration fees for changing the travel dates on components of the tours that are solely operated by Amani Afrika Ltd, this means that you will receive 100% of the credit for the Kilimanjaro trek component of your tour package, where applicable. This credit is for your lifetime, so you can rebook when you are able and ready to travel. However, due to increases in costs, including but not limited to park fees, the latest Kilimanjaro trek price at the time of your rebooking will apply. If there is a significant increase in price, you may be asked to pay for the difference.
Prices are based on current rates of exchange, tariffs and taxes. Amani Afrika reserves the right to increase tour prices to cover increased costs, tariffs and taxes, and to reflect fluctuations in foreign exchange markets. Amani Afrika also reserves the right to withdraw a tour or any part of it to make such alterations in the itinerary or with the tour inclusions as it deems necessary or desirable and to pass on any expenditures or losses caused by delays or events beyond its control. Itineraries and arranged sightseeing are subject to change at any time due to unforeseen circumstances or circumstances beyond Amani Afrika's control. Every effort will be made to operate tours as planned, but alterations may occur after the final itinerary has been issued.
There are certain inherent risks in adventure travel. These include, but are not limited to, altitude sickness, injuries that arise from walking/hiking/climbing, encounter with animals, inaccessibility to medical attention and difficulty in evacuation from remote locations in the case of a medical emergency. Travellers are expected to assume all such risks during their tours.
- Travel Advisories/Warnings
It is the responsibility of the traveller to be informed about the most current travel advisories and warnings issued by the relevant bodies. In the event of an active travel warning against travel to the specific destination(s) of the trip, should the traveller still choose to travel, notwithstanding any travel advisory or warning, the traveller assumes all risk of personal injury, death or property damage that may arise out of the events like those advised or warned against.
- Travellers Representations
The traveller represents that neither he nor she nor anyone travelling with him or her has any physical or other condition or disability that could create a hazard to himself or herself or other members of the tour. Amani Afrika reserves the right to decline to accept anyone on a trip. Amani Afrika reserves the right to remove from the trip, at his or her sole expense, anyone whose condition is such that he or she could create a hazard to himself or others, or otherwise impact the enjoyment of other passengers on the trip.
- Limits on Liability
Amani Afrika does not own all entities which are to or do provide goods or services for your trip. It may purchase transportation (by aircraft, ground transport, ferries or otherwise), hotel and other lodging accommodations, and other services from various independent suppliers. All such persons and entities are independent contractors. As a result Amani Afrika is not liable for any negligent or willful act of any such person or entity or of any third person.
Amani Afrika may act as an agent for the client with respect to transportation, hotel and other tour arrangements. In that capacity, Amani Afrika exercises all reasonable care possible to ensure the traveller's safety and satisfaction, but, Amani Afrika neither assumes nor bears any responsibility or liability for any injury, death, damage, loss, accident, delay, or irregularity arising in connection with the services of any airplane, train, ship, automobile, motor coach, carriage, or other conveyance, or the actions of any third-party involved in carrying the traveller or in affecting these tours.
Amani Afrika is not responsible for damages, additional expenses, or any other losses due to cancellation, delay or other changes in air or other services, sickness, weather, strike, war, civil disturbances, acts or threats of terrorism, travel warnings or bans, termination or suspension of war risks or other carrier insurance, quarantine, acts of God or other causes beyond its control. All such losses must be borne by the traveller, and tour rates provide for arrangements only for the time stated.
Amani Afrika is not responsible for delays, changes or cancellation costs due to incorrect, incomplete or expired traveller documents. In the event of cancellation, delay or rescheduling mandated by any of the aforesaid causes beyond Amani Afrika’ control, the passenger shall have the option of accepting in lieu of the original tour such rescheduled tour or other substituted tour(s) as may be offered, or else, receiving a refund of as much of such advance tour expenditures as Amani Afrika can recover on the traveller's behalf from carriers, third-party tour vendors, etc., but, Amani Afrika shall not have any obligation or liability to the traveller beyond the foregoing.
Amani Afrika reserves the right to make alterations to the tours itinerary and to substitute hotels, vehicles, flights, or activities if this is required. Amani Afrika reserves the right to cancel, delay, or reschedule any tour prior to departure, and, so long as this is not due to any of the aforesaid causes beyond our control, the passenger shall be entitled to a full refund of all monies paid to that point if he/she so desires, less any non-refundable deposits or uncollectible expenses incurred.
In addition and without limitation, Amani Afrika is not responsible for any injury, loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labour activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time.
